Proper use of Delinker - Legal concerns
Analyze the source of your information and make sure it has no restrictions on copying their material. Usually, sites from governments have public information and there are no restrictions in quoting it.
The extent to which someone can use another`s writtings is not very clear, in most countries. There is a consensus on "fair use". We quote:
air use is a copyright principle based on the belief that the public is entitled to freely use portions of copyrighted materials forpurposes of commentary and criticism. For example, if you wish to criticize a novelist, you should have the freedom to quote a portion of the novelist's work without asking permission. Absent this freedom, copyright owners could stifle any negative comments about their work.
Unfortunately, if the copyright owner disagrees with your fair use interpretation, the dispute will have to be resolved by courts or arbitration. If it's not a fair use, then you are infringing upon the rights of the copyright owner and may be liable for damages.
The only guidance is provided by a set of fair use factors outlined in the copyright law. These factors are weighed in each case to determine whether a use qualifies as a fair use. For example, one important factor is whether your use will deprive the copyright owner of income. Unfortunately, weighing the fair use factors is often quite subjective. For this reason, the fair use road map is often tricky to navigate. - Stanford University Libraries |
Our company makes another web promotion tool with similar implications. It is called Synonymizer, and modfies text using synonyms. See that website for details, both technical and legal.
Removing the Link vs. Removing the link plus the Anchor text
Our product allows both options. Although generally speaking leaving the anchor text is better than removing it, it is no guarranty of legal impunity. See this quote:
What If You Acknowledge the Source Material?
Some people mistakenly believe it's permissible to use a work (or portion of it) if an acknowledgment is provided. For example, they believe it's okay to use a photograph in a magazine as long as the name of the photographer is included. This is not true. Acknowledgment of the source material (such as citing the photographer) may be a consideration in a fair use determination, but it will not protect against a claim of infringement. In some cases, such as advertisements, acknowledgments can backfire and create additional legal claims, such as a violation of the right of publicity. When in doubt as to the right to use or acknowledge a source, the most prudent course may be to seek permission of the copyright owner. Stanford University Libraries |
RSS - Real Simple Syndication
RSS is a popular source of free, keyword-specific, thematic content for websites. It is usually made by a title and a short explanation of what the news is about. There is also a link to the main website that hosts the newsfeed (RSS format or other), where you can read the whole story.
We currently search www.NewsIsFree.com, www.Syndic8.com and Yahoo for relevant RSS sources. Almost all RSS feeds are free for the use by anyone, and have no Terms and Conditions limiting their use. However, some RSS feeds have restrictive policies, like the BBC newsfeed. Check before using.
Disclaimer
Editing the links in a newsfeed might violate its Terms & Conditions. This is uncommon but we recommend to check it.
Use of text written by someone else might also violate intelectual property rights. We recommend to check it.
The tools made by our company have at least one legal and ethical purpose. However, some of them can be used improperly and violate other`s rights. Check the law that applies to you before using them.
Some countries are more strict than others at enforcing intelectual property.
In North America, among other places, you should assume a copyright exists, even if not posted. Permission is thus required.
The copyright owner has the right to restrict derivative works, such as a delinked version.
Use of our products implies agreement with these facts.
